1. Acceptance of Terms

Welcome to LuckyCrush. These Terms and Conditions ("Terms", "Agreement") form a legally binding contract between you ("User", "You") and LuckyCrush ("Company", "We", "Us", or "Our"), the operators of en-lucky-crush.com and its associated random video chat services (collectively, the "Service").

By accessing, browsing, or otherwise utilizing the LuckyCrush platform, you acknowledge that you have read, understood, and unequivocally agree to be bound by these Terms, as well as our Privacy Policy. 2. Eligibility and Age Restrictions

To access or use the Service, you must be at least eighteen (18) years of age, or the age of legal majority in your jurisdiction of residence, whichever is older. By entering the site and initiating a video chat, you represent and warrant that:

• You meet the minimum age requirement of 18 years.
• You possess the legal authority, right, and capacity to enter into this Agreement.
• You are not barred from using our services under the laws of the United States or any other applicable jurisdiction.

Zero Tolerance Policy for Minors: We employ a strict zero-tolerance policy regarding the presence of minors on our platform. If we discover, or reasonably suspect, that a user is under the age of 18, their access will be permanently terminated without notice, and their IP address will be blacklisted. If appropriate, we will report such incidents to relevant law enforcement agencies, particularly involving Child Sexual Abuse Material (CSAM).

3. Description of the Service

LuckyCrush provides an online routing platform that randomly connects users worldwide via peer-to-peer live video and text chat. Users may utilize optional filters (such as gender) to tailor their matchmaking experience. Because the matching is random and user-generated, LuckyCrush acts solely as a technological intermediary and does not pre-screen, endorse, or guarantee the conduct or content of any specific user.

4. User Conduct and Prohibited Activities

To ensure a safe and respectful environment for the entire LuckyCrush community, you agree to adhere strictly to our code of conduct. You bear sole responsibility for your behavior and any content you transmit via your webcam, microphone, or text chat.

While using the LuckyCrush random video chat, you explicitly agree NOT to engage in any of the following prohibited activities:

• Illegal Content: Broadcasting, promoting, or distributing any content that violates local, state, national, or international laws.
• Underage Content: Broadcasting or soliciting any content involving minors. This is a severe offense resulting in immediate ban and legal reporting.
• Harassment and Abuse: Engaging in bullying, stalking, intimidation, racism, hate speech, or issuing threats of violence against any matched partner.
• Non-Consensual Recording: Recording, capturing screenshots, broadcasting, or distributing the audio or video of your chat partner without their explicit, prior consent.
• Spam and Commercial Activity: Using the platform to advertise products, solicit money, distribute malware, or redirect users to external commercial websites or adult services.
• Impersonation: Pretending to be another person, a celebrity, or an official representative of LuckyCrush.

5. Moderation, Reporting, and Enforcement

LuckyCrush employs a hybrid moderation system combining advanced Artificial Intelligence (AI) scanning and human oversight to enforce these Terms. Our automated systems may analyze encrypted, momentary frames of video streams to detect severe violations (such as violence or prohibited illicit acts).

Furthermore, we rely on our community to report bad actors. Every chat interface features a "Report" button. If a user is reported, the connection is instantly severed, and their activity log is flagged for review. We reserve the right to temporarily suspend or permanently ban any user—by IP address or device fingerprint—who we believe has violated these Terms, without prior notice or right to appeal. We have no obligation to monitor all content, but we maintain the absolute right to remove any user at our sole discretion.

6. Premium Services, Billing, and Virtual Currency

While basic access to the LuckyCrush random video chat is free, we offer premium features, virtual minutes, and VIP filtering options for a fee. If you choose to purchase any premium services, you agree to our billing terms:

• Payments: All transactions are processed through secure, third-party payment providers. You authorize us to charge your selected payment method for the full amount of your purchase.
• No Refunds: Due to the immediate, digital nature of the services provided, all purchases of premium minutes or VIP upgrades are final and non-refundable. Exceptions are made solely at our discretion in the event of verifiable, severe technical failures on our servers that entirely prevented the use of purchased credits.
• Account Bans: If you are permanently banned from the LuckyCrush platform for violating these Terms of Service, any remaining premium minutes or virtual currency in your possession will be immediately forfeited without compensation.

7. Intellectual Property Rights

All content, features, code, design elements, and functionality of the LuckyCrush platform—including but not limited to our logo, brand name, software, and user interface—are the exclusive property of LuckyCrush and are protected by international copyright, trademark, and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the Service for your personal, non-commercial entertainment. You may not copy, modify, distribute, reverse engineer, or create derivative works based on our platform or its underlying code without our express written permission.

8. Disclaimers and Assumption of Risk

Your use of the LuckyCrush random video chat is entirely at your own risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without any warranties of any kind, either express or implied.

We specifically disclaim any warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or entirely secure. Because LuckyCrush pairs you with anonymous strangers, we cannot control, and are not responsible for, the actions, words, or visual broadcasts of other users. You acknowledge that you may encounter content that you find offensive, indecent, or objectionable, and you agree that LuckyCrush bears no liability for your exposure to such content.

9. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall LuckyCrush, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of (or inability to access or use) the Service.
• Any conduct or content of any third party on the Service.
• Any unauthorized access, use, or alteration of your transmissions or content.

In no event shall our total liability to you for all claims related to the Service exceed the amount you paid to us, if any, for accessing premium features during the twelve (12) months immediately preceding the claim.

10. Indemnification

You agree to defend, indemnify, and hold harmless LuckyCrush and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your device; b) a breach of these Terms; or c) content broadcasted by you via the Service.

11. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which LuckyCrush's primary operating entity is registered, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

12. Amendments to the Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
